The Community Council would like to point out that it understands that the map shown in option agreement three is inaccurate and the land does not in fact extend to the A44 (between Larch Grove and the fence line). Map to be attached. The necessary notice and consent for that vital section of land has not therefore been served on the landowner.
Planning Application 18/1016 Discharge of Condition 43, Archaeology –
The Community Council understands that an archaeologist was not on site as required at the start of any works and during the initial stages of works.
Planning Application 18/1008 Discharge of Condition 40, Habitat Management
No input yet received from Natural Resources Wales and this is considered essential before this condition is discharged.
Planning Application 18/1009 Discharge of Condition 41, Ecological Monitoring
No input yet received from Natural Resources Wales and this is considered essential before this condition is discharged.
Planning Application 18/0984 Discharge of Condition 23, Surface Water Management
Condition 37 of the planning permission expressly states that no development shall be commenced until this condition has been discharged - why is it therefore being allowed to not only commence but to continue? Again no response as yet from Natural Resources Wales. Run off is presently not being managed and is reaching the A44 and thus adjacent water courses.
Planning Application 18/0985 Discharge of Condition 24, Water Quality Monitoring
The Community Council understands that very few baseline monitoring samples have been taken and indeed only three properties approached despite 16 properties having been identified by PCC as possibly being affected. Work should not be allowed to continue until all have been properly sampled. The Community Council also feels that underground aquifers should be identified so that any impact can be fully assessed.
Planning Application 18/0992 Discharge of Condition 29, Construction Traffic Management Plan
The Community Council supports completely the comments of PCC Officers Jill Exton and Dale Boyington on the issues of concern. Steps should be taken immediately to ensure that no further traffic enters the site until a full plan has been approved to discharge this condition.
Planning Application 18/0998 Discharge of Condition 51, NoiseThe plannng condition asked for a list of consultants to be provided, the applicant has only provided one. The Community Council is concerned about approving a list of one, as in the event of a noise complaint if that consultant isn't available then there could be a delay in investigating.
Planning Application 18/0989 Discharge of Condition 25, Public Rights of Way
As far as the Community Council is aware there has been no application to close or restrict CROW land access or to obtain permission to carry out work on a common. The need to guarantee safety of the public should be a priority. The Community Council supports completely the comments of PCC Officer, Jill Exton, on the issues of concern. Commons graziers should also be consulted.

Again the Community Council supports the comments of PCC Officers Jill Exton and Dale Boyington on the issues of concern. The details supplied do not appear to relate to the plan in the original application. Do the traffic lights on the A44 have the necessary permit?

The Community Council notes the comments of Jason Ingram from the Dept of Economy and Infrastructure that insufficient information has been provided particularly with regard to pedestrians, AILs, hold points for loads, parking off carriageways etc.

There has been little or no liaison with the community.
Planning Application 18/1006 Discharge of Condition28, Abnormal Load Traffic Management Plan -The Community Council has read the consultee response from Dale Boyington of the Highways Section of PCC and agrees completely with all the views and statements expressed including -
Condition 49 - there appears to have been no attempt to apply for the necessary permission to carry out works on common land and this should be investigated as a matter of urgency.
In general the developers appear to be proceeding with absolutely no regard for the planning process or indeed any regulations regarding commons, rights of way or highways. Urgent action is required by the County Council to halt all works while the planning process is correctly followed.

The proposed development far exceeds the 5mw maximum capacity for small wind farms outside the Strategic Search Areas defined in Welsh Government document, TAN 8 and should be refused for the following reasons - the proximity to nearby bridleways and rights of way, the recommended distance from any bridleway is 3x turbine height, equating to 330m in this case. However the nearest right of way to the turbines is just 200m away, representing a clear danger to all users, not only horse riders but also walkers and cyclists; the adverse visual impact on the A44 and on tourism, a principal leisure route into Wales (a route recognised as having high scenic value in the recent planning inspectorate decision on the turbine application at Pentre Tump) and the resultant effect on tourism; sited outside Strategic Search Area, wind farms over 5mw (this site being 17.5mw) should, as indicated in TAN 8, be restricted to Strategic Search Areas or brown field sites. To grant permission for this development would industrialise an area of exceptional natural beauty; detriment to the local landscape, the views enjoyed from the site area and from surrounding hills, roads and rights of way would be severely detrimentally affected. The Unitary Development Plan for Powys states that a wind farm should only be considered where there is no adverse effect on the landscape; damage to local wildlife, in particular the local bird population (the email sent to PCC from the Radnorshire County Bird Recorder details many species which would be affected and analyses the present numbers of those species in the area).
